All members of the Jessup community are entitled to an employment and educational environment that is free from sexual discrimination and harassment. As noted in the previous video, sexual harassment and sexual violence can include several types of prohibited conduct. Full definitions are included in Jessup’s Title IX Policy, here's what you need to know:

Sexual Harassment

Sexual harassment can include:

Actions that substantially and materially deprive, limit or deny a member of the Jessup community of educational or employment access, benefits or opportunities including disparate treatment, based on the individual’s sex.
Conditioning the provision of an aid, benefit, or service on an individual’s participation in unwelcome sexual conduct;
Unwelcome conduct that a reasonable person would determine to be so severe, pervasive, and objectively offensive that it effectively denies a person equalaccess to Jessup’s education program or activity;
Sexual assault, dating violence, domestic violence, or stalking.

Additionally, the California Education Code defines sexual harassment as unwelcome sexual advances, requests for sexual favors, and other verbal, visual, or physical conduct of a sexual nature, made by someone from or in the work or educational setting, where submission to the conduct is a condition of an individual's employment, academic status, or progress; including any decision affecting the individual regarding benefits and services, honors, programs, or activities or that has a negative impact upon the individual's work or academic performance, or creates an intimidating, hostile, or offensive work or educational environment.

Sexual Assault, Violence, and Other Prohibited Conduct

Sexual assault includes any sexual act directed against another person, without the consent of the victim, including instances where the victim is incapable of giving consent. Sexual assault and other forms of violence and conduct are prohibited under Title IX:

Rape: The penetration, no matter how slight, of the vagina or anus with any body part or object, or oral penetration or copulation by a sex organ of another person, without the consent of the victim.
Fondling/Sexual Battery: The touching of the private body parts of another person for the purpose of sexual gratification, without the consent of the victim, including instances where the victim is incapable of giving consent because of his or her age (below the statutory age of 18) or because of his or her temporary or permanent mental incapacity. It also includes intentionally causing a person to touch the intimate parts of another without consent, or using a person’s own intimate part to intentionally touch another person’s body without consent.
Incest: Sexual intercourse between persons who are related to each other within the degrees wherein marriage is prohibited by law.
Statutory Rape: Sexual intercourse with a person who is under the statutory age of consent (18 years old).
Dating Violence: Violence committed by a person: (A) who is or has been in a social relationship of a romantic or intimate nature with the victim.
Domestic Violence: A felony or misdemeanor crime of violence committed by a current or former spouse or intimate partner of the victim, or by a person with whom the victim shares a child in common, or by a person who is cohabitating with or has cohabitated with the victim.
Stalking: Engaging in a course of conduct (two or more acts) directed at a specific person that would cause a reasonable person to fear for his or her safety or the safety of others or suffer substantial emotional distress. This can include acts in which the stalker directly, indirectly, or through third parties, by any action, method, device, or means, follows, monitors, observes, surveils, threatens or communicates to or about a person, or interferes with a person’s property. This can take place over electronic communication such as emails, text messages, or social media.
Sexual Exploitation: Taking sexual advantage of another person for the benefit of anyone other than that person without that person’s consent. It can include prostituting or trafficking another person, recording and distribution of images/audio of another person’s sexual activity or intimate parts and viewing another person’s sexual activity or intimate parts, in a place where someone would have a reasonable expectation of privacy, for the purpose of arousing or gratifying sexual desire.

Jessup can impose any level of sanction, up to and including expulsion/termination in response to a finding of responsibility for the following prohibited conduct. In addition, this conduct is punishable by applicable State and Federal law.
